TERMS OF USE (the not-so-small print)
We’d love you to purchase products from us and use our website. But please read these Terms of Use as well as our Privacy Policy/GDPR statement and our non-edible Cookie Policy first. There are some additional terms and conditions for Club members using our subscription wine service here. Ideally, print and keep a copy of all these for your reference. We may change the content of the site from time to time, including the terms of use.
Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.
You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any UK laws (including but not limited to copyright laws).
You must not transmit any worms or viruses or any code of a destructive nature.
By using the site, you agree that you have read, understood and accept these Terms (as amended from time to time). If you do not agree to be bound by these Terms, you may not use or access the site or place an order with us. Sorry, but we all want to stay legal and safe.
Who we are
In these Terms, “we” or “us” refers to Terra Sarda Wines, which is operated by Terra Sarda Tours Ltd, a company incorporated in England and Wales (registered number 09593382).
Our registered office is 81-83 Market Place, Pocklington, East Yorkshire YO42 2AR. Our day-to-day trading address is July Cottage, 42 Burnby Lane, Pocklington, East Yorkshire YO42 2QE. Our registered VAT number is 482 9670 46.

Terms of Sale
You can place an order with us by using our online service, by email or by phone.
We might decline to accept an order because of one of the following:

The product(s) you ordered are not in stock and are unlikely to come into stock

We are not able to verify that you are aged over 18

We identify a pricing or product description error

We cannot obtain authorisation for your payment
Availability
All products and services are subject to availability. Our producers are very small and may not be able to satisfy high demand. We will endeavour to make customers aware through the site if a wine is running low in stock or is out of stock. If a wine goes out of stock while processing your order, we will contact you to let you know and offer an alternative, or you can cancel your order.
Our quarterly selection boxes contain six wines as stated on the website. These wines change every three months. We cannot substitute wines within this selection with other wines, but you can purchase single varietal or self-selected mixed cases of six wines from our online shop in addition to your quarterly subscription case.
Age Restrictions
Remember, it is against the law in the UK for any person under the age of 18 to buy, or attempt to buy alcohol or for any person over the age of 18 to buy or attempt to buy alcohol for any person under the age of 18. By placing an order, you confirm that you and the recipient of the wine are at least 18 years old.
In some circumstances we may contact you to ask for a driving licence number (or other form of age verification) in order to proceed with the order.
Our website is only available to those aged 18 years and over. By using it, you agree that you are aged 18 or over. If you are not, you must not use it. You are also responsible for ensuring that all persons who access the site through your Internet connection are aware of these Terms and that they comply with them.
Prices
All prices are quoted in pounds sterling, per bottle or per case, as listed on the site. The prices include UK duty and VAT. Any delivery charges are additional, unless otherwise stated.
Although we endeavour to ensure that all pricing information on our site is accurate, occasionally products may be incorrectly priced. In the event that a product you have ordered is listed at an incorrect price we will contact you by telephone or email before despatching your products, firstly to apologise and then asking you to confirm if you still wish to proceed with your order at the correct price or cancel your order.
If you do not confirm that you wish to proceed with the order within seven days of the date of our email, we will cancel the order.
We reserve the right to alter prices without notice in the event of major currency fluctuations, changes in the rate of duty, VAT or other taxes or import tariffs or other market conditions. We also reserve the right to terminate any special offer at any time, without notice.
Re-Sale
Wines purchased from us are for the customer's own use (which may include their use as gifts for third parties). Wines may not be re-sold or otherwise used for commercial purposes.
Liability
Please note that the images of the products on our website are for illustrative purposes only. We cannot guarantee that your device's display of the colours accurately reflect the colour of the products. The products you purchase may vary slightly from those images.
You have certain legal rights in respect of any products or services you purchase from us, including that such products are of satisfactory quality and that services are provided with reasonable care and skill. You have certain legal remedies if we breach these rights. Nothing in these Terms of Sale is intended to affect or limit these legal rights or other rights to which you may also be entitled, for example to damages. For more information about your legal rights please contact your local Citizens Advice Service or Trading Standards Service.
Our liability for any losses, damage or costs you suffer as a result of us failing to comply with these Terms of Sale is strictly limited to any losses, damage or costs which are a foreseeable consequence of such failure. Loss, damage or a cost is foreseeable if either it is obvious that it will happen, or if, at the time the contract was made, both we and you knew it might happen.
We are not responsible for any delay in, or failure of, performance of our obligations under these Terms of Sale arising from any event which is outside of our control (for example, an act of God, governmental act, war, fire, adverse weather conditions including snow, flood or storm, explosion or civil commotion, failure of a third party (other than our sub-contractors) or in information technology or telecommunications services, or industrial action). In the event of a significant delay or failure, we will contact you and take reasonable steps to minimise the effect of the delay or failure. If you are unhappy with a delay which affects your order, you may cancel the order and receive a refund for any products you have paid for but not received by contacting us. If you subsequently receive your order after cancelling it and getting a refund, you must let us know and allow us to collect the products you have received.
We will not be liable to you or to any third party for any loss, damage or costs which arise as a result of:

Your failure to store or otherwise handle any product in an appropriate and safe manner; or

Your failure to comply with the recommendations set out in the “Responsible drinking, handling and storage” sections below; or

Any spillages or breakages involving one or more of our products, unless such loss, damage or cost arises as a result of our negligence or one of our products being faulty or defective.
Nothing in these Terms of Sale shall affect our liability for death or personal injury arising from our negligence, for fraud, or any other liability which cannot be excluded or limited under applicable law.
Responsible drinking
Alcohol should be consumed in moderation. The recommended weekly limit for men and women is 14 units of alcohol. For guidance, one 125ml glass of wine that is 12% ABV is one unit. It is safest not to drink alcohol when pregnant.
Handling and storage
Our couriers will do their best not to unduly upset your wines, but sparkling wines in particular do not like travelling. We recommend you leave them to settle after delivery and always take extra care when opening sparkling wines.
You will find recommendations for serving temperature, decantering etc in the tasting notes that accompany your delivery and on this site, but where possible, you should store bottles horizontally in a stable, cool temperature, out of direct light.
Membership accounts
If you open a Club membership account with us you agree that:

You will provide current, complete and accurate purchase and account information. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed. You will notify us immediately of any changes to the personal information by updating your details within the “My Details” section within your online account or by contacting us.

You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks. For more information on how we handle your personal date, see our GDPR statement.
Payments, cancellation and skipping
We will collect your subscription payment once a month on your requested day of the month.
As soon as three monthly payments have been collected, your case of six wines will be dispatched. We will send you an email confirming they are on their way [see Delivery information].
We will email you after every payment collection towards your subscription case to remind you that you can cancel or pause your subscription at any time, When your third monthly subscription has been collected, we will advise of any delivery charge to be debited from your account. Your wines will then be dispatched.
If you cancel your subscription, any funds accrued in your wine wallet can be spent on our site, or you can choose to have them refunded to your linked payment account.
You can also choose to skip a payment. If you choose to skip a payment, we will wait until sufficient funds have built up in your account before we send you your next subscription box.
If you don’t want to wait to receive your subscription case, you can purchase wines in the current or previous Editions through the Members’ Shop at the membership price.
Your subscription payment will still be collected and used to pay towards your next scheduled subscription case.
Intellectual Property Rights
All present and future copyright, design rights, unregistered designs, database rights, registered and unregistered trade marks and any other intellectual property rights attached to the Site, including written content, are owned by us. No part of the site can be reproduced without seeking consent from us.
You may post reviews or ratings of our wines on or through the Site but we reserve the right to remove or edit any submissions.
By submitting a review or rating you agree to allow us to publish your submission and any name attached to it in any media associated with Terra Sarda Wines.
We process information about you in accordance with our Privacy Policy. By using the Sites you consent to such processing and you warrant that all data provided by you is accurate.
